Terms of Service

1. Acceptance of These Terms

By accessing this website, joining the roster, entering our community channels, or accessing the game once it becomes available, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the website or the game. These Terms form a binding agreement between you and ODY Technologies e.U. ("we", "us", "our").

2. The Service

"The Service" means this website and the game Galaxy Online — A New Beginning, together with related community channels, updates, and content we provide. The website is currently a pre-launch teaser; the game is in active development. Features described here or on the site are plans, not promises, and may change or be discontinued.

3. Eligibility

You must be at least 16 years old to use the Service or to submit your email to the roster signup. By using the Service you confirm that you meet this age requirement and that you are legally able to enter into these Terms.

4. Roster Signup & Communications

If you submit your email to the roster, you agree to receive development updates and a one-time invitation when the Alpha opens. You can unsubscribe at any time via the link in each email. How we handle your email is described in our Privacy Policy.

5. Pre-Release & Alpha Software

The game is unfinished, pre-release software provided for testing and feedback. It may contain bugs, change substantially, be unavailable, or be discontinued at any time. Game worlds, characters, progress, and virtual items may be reset, wiped, or lost during development, and we do not guarantee that any Alpha or test data will carry over to later versions or to launch. We make no promise that the game will ever be publicly released.

6. Accounts

When game accounts become available, you are responsible for keeping your login credentials secure and for all activity under your account. Accounts are personal to you, non-transferable, and limited to one per person unless we say otherwise. You must provide accurate information and keep it up to date. We may suspend or close accounts that violate these Terms.

7. Acceptable Use

You agree not to:

• cheat, or use bots, automation, exploits, or third-party software that gives an unfair advantage or disrupts the game;
• harass, threaten, defame, or abuse others, or post illegal, hateful, or infringing content;
• access accounts, systems, or data that are not yours, or attempt to breach security;
• reverse-engineer, decompile, or extract source code, except where the law expressly allows it;
• sell, buy, or trade accounts, virtual items, or currency outside mechanisms we officially provide;
• disrupt, overload, or interfere with the Service or with other players' use of it.

8. Virtual Items & Currency

Any in-game items, currency, ships, or other virtual goods are licensed to you for use within the game only. They have no real-world monetary value, are not your property, and cannot be exchanged for cash. We may modify, remove, or reset virtual goods at any time, particularly during Alpha. If you purchase virtual goods in the future, your statutory consumer rights remain unaffected; beyond those, purchases of consumed digital content are non-refundable.

9. Intellectual Property

The Service — including the game, its name, logos, artwork, lore, characters, music, and code — is owned by ODY Technologies e.U. or its licensors and is protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, distribute, or create derivative works from our content without our written permission. Any content you submit (e.g. names, community posts) remains yours, but you grant us a worldwide, royalty-free licence to host and display it as part of operating the Service.

10. Third-Party Services

The Service relies on third parties — including Cloudflare (hosting), Brevo (email), and Discord (community), and in future may include storefronts and payment providers such as Steam. Your use of those services is also governed by their own terms and privacy policies, which we do not control.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law — this applies especially to pre-release Alpha software. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data will be preserved. Nothing in these Terms excludes rights that cannot be excluded under mandatory Austrian or EU consumer law.

12. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, progress, or virtual items arising from your use of the Service. Our liability for slight negligence is excluded, except for injury to life, body, or health, or for breach of essential contractual obligations. Mandatory liability under Austrian law (including the Product Liability Act) and your statutory consumer rights remain unaffected.

13. Term & Termination

You may stop using the Service at any time and unsubscribe from our emails. We may suspend or terminate your access — including any account — if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and liability) will continue to apply.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and nothing here deprives you of those rights. Place of jurisdiction is, to the extent legally permissible, the competent court in Austria.

15. Changes to These Terms

As the game evolves (game client, accounts, payments, in-game chat), we may update these Terms. We will post the updated version here and, for material changes, announce them on the website and by email to roster members before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
